We at AlixPartners, LLP, along with our subsidiaries (collectively, “AlixPartners”), respect your concerns about privacy.  This Online Privacy Notice applies only to personal information we collect on this website.  The notice describes the types of personal information we collect, how we use the information, and with whom we share it.  We also describe the measures we take to protect the security of the information and how to contact us about our privacy practices.

You may choose to submit personal information on our website.  Here are the types of information we collect and the ways we may use the information. 


Information You Provide


Electronic Proof of Claim Form 
To the extent authorized by order of a United States Bankruptcy Court with appropriate jurisdiction, you might be able to submit an electronic Proof of Claim Form on this website.  In connection with doing so, you might provide a name, postal address, email address, telephone number, debtor details and other information about you or the claim (such as documents that support the claim).  We may use this information for any purposes related to the claim administration or bankruptcy process, including without limitation claims analysis, objections, plan solicitation and voting, notice and other matters.  


As indicated in the filing instructions on the site, we require all filers to redact from the documents they submit on the site information such as Social Security numbers, taxpayer identification numbers, birth dates, names of minor children and financial account numbers, as required by Rule 9037 of the Federal Rules of Bankruptcy Procedure.  We are not responsible for any failure of you or your representatives to redact details from information or documents submitted to us.

If you communicate with us through the “Contact Us” link on this site, we may ask you for information such as your name, email address, postal address and telephone number.  We use this information to respond to your request.  If you request information that requires the response of a third party, we may forward your contact information to that third party to respond.   


Information We Collect by Automated Means

The information and documents you submit to us in connection with submitting any proof of claim on this site will become a matter of public record and we may make publicly accessible or provide to any party such information or copies of such documents.  We also may share any information with our affiliates and service providers who perform services on our behalf.  These service providers are not authorized by us to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements.  We require these service providers by contract to appropriately safeguard the privacy and security of personal information they collect, use, disclose or otherwise process on our behalf. 


In addition, we may disclose information about you (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity.  We also reserve the right to transfer personal information we have about you in the event we sell or transfer all or a portion of our business or assets.  Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use personal information you have provided to us on our website in a manner that is consistent with our Online Privacy Notice.


Access and Correction


You may request a copy of any personal information we collect from you on this site or ask us to update or correct any inaccuracies in such information, other than information contained in a Proof of Claim Form submitted on this site.  You may access electronically filed Proof of Claim Forms on this site.  Amending any electronically filed Proof of Claim Forms is governed by applicable legal requirements.  Subject to applicable law, we may limit or deny access to personal information where providing such access is unreasonably burdensome or costly under the circumstances.   


Transfer of Personal Information to Other Countries
